SAVE VIDEO PLUGIN FOR INTERNET EXPLORER SOFTWARE LICENSE AGREEMENT

IMPORTANT: YOU SHOULD CAREFULLY READ THIS LEGAL AGREEMENT BEFORE INSTALLING THIS PACKAGE. BY INSTALLING SAVE VIDEO PLUGIN FOR INTERNET EXPLORERYOU ACCEPT ALL THE TERMS AND CONDITIONS OF THIS AGREEMENT AND AGREE THAT YOU WILL BE LEGALLY BOUND BY THEM. IF THESE TERMS AND CONDITIONS ARE NOT ACCEPTABLE TO YOU, DO NOT CONTINUE TO INSTALL THIS SOFTWARE.

SAVE VIDEO PLUGIN FOR INTERNET EXPLORER LICENSE TERMS

SVSoftware LTD ("SVSoft") grants you ("Customer") a license to use Save Video plugin For Internet Explorer ("Save Video") and their documentation, subject to the separate, applicable provisions below. Save Video plugin For Internet Explorer may also be called "Save Video" or "Save Video plugin" in documentation, web site and the program itself.
1. LICENSE FOR SAVE VIDEO FREE SOFTWARE

Save Video plugin Free Trial is defined as Save Video for which Customer did not pay to SVSoftware or a reseller authorized by SVSoftware.

Customer may use Save Video Free Trial during the Trial Period of ten (10) days, starting on the date of the first installation of Save Video plugin on Customer's computer.
Customer must purchase Save Video plugin once the Trial Period ends or uninstall it. During uninstall you can select "do not uninstall FLV player" option. FLV Player and FLV Converter is free components included in install package. Each Customer is allowed only one trial.
Save Video plugin uses code of FFmpeg (http://ffmpeg.org) licensed under the LGPLv2.1(http://www.gnu.org/licenses/old-licenses/lgpl-2.1.html) and its source can be downloaded here - http://www.savevideoplugin.com/ffmpeg/ffmpeg_src.zip

Customer agrees that Save Video Free Trial has certain limitations, that these limitations may change over time without notice or obligation on the part of SVSoft. These limitations are described at http://www.howtosavevideo.com and are incorporated into this Agreement by reference.
The Customer agrees to be legally bound by these limitations when using Save Video Free Trial.
2. LICENSE FOR SAVE VIDEO PRO (PAID-FOR VERSION)

Save Video Pro is defined as Save Video plugin for which Customer did pay to SVSoft or a reseller authorized by SVSoft.

Customer who purchased a license for Save Video Pro is granted a nonexclusive license to use Save Video Pro on a single computer only.

If a Customer has several computers, Customer shall purchase additional Save Video Pro licenses for each computer that Customer installs Save Video Pro on.

Customer shall not use Save Video Pro for commercial timesharing.
Customer shall not rent Save Video Pro license to other parties.

ONLINE ACTIVATION: Customer hereby agrees to Online Activation process for Save Video Pro in which Save Video checks the validity of Customer's Save Video Pro license by contacting the SVSoft via the Internet.
Customer also agrees that Online Activation may be used to enforce provision of this Agreement that allows use of one Save Video Pro license only on one computer.
3. COMMON PROVISIONS FOR SAVE VIDEO PRO

SAVE VIDEO PRO USERS MANAGEMENT SYSTEM: Personal data of customers that purchase Save Video Pro is stored in Save Video Pro Users Management System.
Only the data that customers or their agents enter into the Save Video Pro purchase web page is stored in the database.

Customer hereby allows SVSoft to store this data. This data shall be used for purchase tracking, reactivation of Save Video Pro licenses, refund and chargeback tracking and other customer service purposes.

Customer allows SVSoft to send infrequent product update newsletters and promotional offers to email and postal addresses stored in Users Management System.
4. GENERAL PROVISIONS FOR SAVE VIDEO

All provisions in this section apply both to Save Video Free Trail/Pro even if only Save Video plugin is mentioned.

COPYRIGHT/OWNERSHIP OF PROGRAM: Save Video plugin is the proprietary product of SVSoft and its licensors and it is protected by copyright, trade secret and other intellectual property laws.

Customer acquires only the right to use Save Video plugin and does not acquire any rights, express or implied, in Save Video plugin or media containing Save Video plugin other than those specified in this License.

SVSoft, or its licensor, shall at all times retain all rights, title, interest, including intellectual property rights, in Save Video and media.

Customer shall not remove any product identification, copyright notices, or other notices or proprietary restrictions from Save Video plugin.

Customer shall not cause or permit reverse engineering, disassembly, or decompilation of Save Video plugin.

TRANSMISSION OF DATA IN AUTOUPDATE:
Save Video plugin checks SVSoft server(s) for its new version and security patches approximately once a day.
If it finds a version that is newer than the version that you have, Save Video plugin will offer you to upgrade.
The checking of new version results in technical data such as operating system and browser version and Registration Data to be transmitted to SVSoft server and stored on this server.
Customer hereby allows such transmissions to occur.

Customer allows SVSoft to send infrequent product update newsletters and promotional offers to email addresses obtained from Registration Data.

UNINSTALL INSTRUCTIONS:
Customer may uninstall Save Video plugin at any time by going to Control Panel, clicking Add/Remove Software selecting Save Video plugin For Internet Explorer and clicking the Remove button.

NO WARRANTIES OF ANY KIND: SAVE VIDEO PLUGIN IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.
SVSOFT DOES NOT WARRANT THAT THE FUNCTIONS CONTAINED IN SAVE VIDEO PLUGIN WILL MEET YOUR REQUIREMENTS OR OPERATE IN AN ENVIRONMENT CREATED BY YOU OR THAT THE OPERATION OF SAVE VIDEO PLUGIN WILL BE UNINTERRUPTED OR ERROR FREE OR THAT SAVE VIDEO PLUGIN ERRORS WILL BE CORRECTED.
THE ENTIRE RISK AS TO THE QUALITY AND PERFORMANCE OF SAVE VIDEO PLUGIN IS WITH YOU.

LIMITATION OF LIABILITY: NEITHER SVSOFT NOR ANY OF ITS LICENSORS SHALL BE LIABLE FOR ANY DAMAGES CAUSED BY SAVE VIDEO INCLUDING BUT NOT LIMITED TO INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES, OR DAMAGES
FOR LOSS OF PROFITS, LOSS OF SAVINGS, REVENUE, DATA, INCURRED BY CUSTOMER OR ANY THIRD PARTY, EVEN IF SVSOFT HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TERMINATION: This License is effective until terminated or upon expiration of the 10-day free trial period where applicable. You may terminate this Agreement at any time by uninstalling Save Video and deleting all its files. This License will terminate immediately without notice from SVSoft if you fail to comply with any provision of this License.
Upon termination or expiration of this License you must uninstall Save Video and delete all its files.

TRADEMARKS: Save Video plugin for Internet Explorer, SVSoft and SVSoftware are trademarks and/or trade names owned by SVSoftware LTD.
ANY UNAUTHORIZED USE OF THESE TRADEMARKS AND/OR TRADE NAMES OR ANY OTHER INTELLECTUAL PROPERTY OWNED BY SVSOFT OR ITS LICENSORS IS PROHIBITED.

JURISDICTION AND DISPUTES: This Agreement shall be governed by the laws of Ukraine. All disputes here under shall be
resolved in the applicable courts of Ukraine. The parties consent to the jurisdiction of such courts, agree to accept service of process by mail, and waive any jurisdictional or venue defenses otherwise available. In any litigation arising out of this Agreement or related to use or function of Save Video, SVSoft shall be entitled to all legal costs and attorney's fees incurred in mediation, arbitration, suit and on appeal.

SEVERABILITY: If for any reason a court of competent jurisdiction finds any provision of this License or portion thereof, to be unenforceable, that provision of the License shall be enforced to the maximum extent permissible so as to affect the intent of the parties, and the remainder of this License shall continue in full force and effect.

COMPLETE AGREEMENT: This License constitutes the entire agreement between the parties with respect to the use of Save Video and the related documentation, and supersedes all prior or contemporaneous understandings or agreements, written or oral, regarding such subject matter. No amendment to or modification of this License will be binding unless in writing and signed by a duly authorized representative of SVSoft.

5. PRIVACY

SAVE VIDEO WEB SITE: Save Video web site may use cookies to track users.

Save Video affiliates and advertisers may also use cookies.

SAVE VIDEO PRO PURCHASES: see Section 3 for privacy provisions.

CUSTOMER HEREBY ACKNOWLEDGES THAT CUSTOMER HAS READ THIS AGREEMENT, UNDERSTANDS IT AND AGREES TO BE BOUND BY ITS TERMS AND CONDITIONS.
